Notices:

There are several types of Notices that might be presented to the accused by the prosecutor at an arraignment. These notices include:

CPL 710.30

A 710.30 notice comes in two forms. The first type is a “Statement Notice” where the police claim that the accused has made a statement that will be introduced by the prosecution at a trial.    The statement may be written, oral or recorded. The second type is an Identification Notice and is used where the police have used some type of identification procedure to identify the accused. There are several types of identification procedures used by police.

CPL 450.10

A 450.10 notice puts the defense on notice that the prosecution is in possession of certain property that they intend to release to its owner and accordingly, the defense is granted a brief period to inspect the property prior to its release. A classic example occurs in a Petit Larceny case where items allegedly stolen are recovered and will be returned to their owner rather than being held by the prosecution during the pendency of the case.

CPL 190.50


The 190.50 notice occurs in felony cases where the prosecution chooses to announce that the matter will be presented to a Grand Jury.
